I/we are the authorized user of this program and are sending to Spectrum Software, Inc. our invoice along with this order form to establish such proof of license. If this declaration is being made on behalf of a corporation or other business entity, I have been authorized by that business entity to execute this Declaration on its behalf. If on behalf of an individual, I am authorized to execute this Declaration. I understand that the primary purpose, design and marketing of the software I wish to purchase from Spectrum Software, Inc. is to permit a noninfringing use of the software I am authorized to use.

I have experienced a hardware lock (dongle) malfunction or a damaged dongle and my dongle has become obsolete and have not been able resolve this with the manufacturer. Or my situation falls within other exemptions granted under the DMCA, those reasons are defined at http://www.copyright.gov .

I acknowledge that the Spectrum Software, Inc. product does not and will not circumvent any technological measure prohibited under the Digital Millennium Copyright Act and such product is a one for one replacement of my malfunctioning or damaged dongle.

I have read title 17, chapter 12 above and the exemptions granted and hereby swear and affirm that I/my company qualifies for such relief. I agree to hold harmless and indemnify Spectrum Software, Inc and its employees both corporately and personally against any and all claims arising out of the purchase or use of their software.

I hereby declare under penalty of perjury that the foregoing statements are true and correct.
